The Piper Alpha oil platform disaster of 1988 killed 167 men in the North Sea. What Lord Cullen's two-year public inquiry found was that no single decision caused the disaster. Every decision, taken alone, was defensible. The cluster killed the men. What the offshore oil industry built afterward — the Safety Case regime — became one of the most successful regulatory frameworks of the modern era. A methodology that required someone to add up the whole.
Thirty-eight years later, the American data center buildout has the same problem, in a different industry. Loudoun County, Virginia has 199 operating data centers, 117 more under construction, and forty percent of its budget from data center taxes. It also has 185-foot transmission lines being approved to run through Vicky Hu's backyard, past two schools, in a subdivision the county's own government agrees will suffer substantial and unmitigated harm. Nobody in Loudoun ever voted on the cluster. Nobody was ever empowered to.
In Social Circle, Georgia — a town of five thousand where some of you are listening from — the same story is happening in real time, with four separate data center votes in twelve months. In Oklahoma, a Republican state senator saw the pattern and tried to build the framework before her state became a Loudoun or a Social Circle. The bill died in committee.
This is the eighty percent of the story that never makes the local news: the methodology to add up the whole exists. The requirement to use it does not. That's a policy choice, sitting in front of legislatures right now.

Piper Alpha And The Safety Case
SPEAKER_01On the night of July 6, 1988, in the North Sea about 120 miles northeast of Aberdeen, Scotland, there was an oil platform called Piper Alpha. Two hundred and twenty-six men were on it. By morning, one hundred and sixty-seven of them were dead. I'm going to tell you the story, but not the way it usually gets told, because the way it usually gets told is a warning. I want to tell it the other way. I want to tell it as a success story about something someone eventually figured out how to do. Stay with me on that. The disaster started with a maintenance job. A pump on the platform had a pressure safety valve removed for inspection. The valve was going to be reinstalled the same day, but the crane wasn't available, so it wasn't. A flat metal plate called a blind flange was fastened over the open pipe, hand tightened most likely, because the valve was supposed to go back on soon. At the shift change the paperwork on that maintenance job did not clearly reach the night crew. Later that evening a different pump failed. The night crew, not knowing about the missing safety valve, restarted the pump that had been out of service. The flange leaked gas. The gas found an ignition source. The gas exploded. That's the first explosion. It's not what killed most of the people who died. What killed most of the people who died was that two other platforms called Tartan and Claymore were connected to Piper Alpha by undersea pipelines. Those pipelines were pumping oil and gas to Piper Alpha in real time. Both platforms could see Piper Alpha on fire. Both platforms kept pumping. On Claymore, the manager waited for permission from the onshore control center to shut down. On Tartan, the offshore installation manager had received a directive from a superior, and he wasn't going to countermand it on his own authority. So the pipelines kept pumping fuel into the platform that was burning, and about twenty minutes into the disaster, the first of those pipelines ruptured, and the fireball that resulted is what killed most of the men in the accommodation block. The public inquiry into what happened lasted two years. It was led by a Scottish judge named Lord William Cullen. Cullen's final report was four hundred pages in two volumes with one hundred and six recommendations. All one hundred and six were accepted by the industry. Here is the part that matters for this episode. Cullen looked at every single decision that had been made in the days and hours before the disaster, and what he found was that every single one of them, taken by itself, was defensible. The maintenance job was routine, the blind flange was standard, the pump restart followed the procedure. The Tartan manager was following his superior's instruction. The Claymore manager was waiting for authorization from shore, which was exactly what his procedures told him to do. Nobody in that chain of decisions did the reckless thing. Every one of them did the reasonable thing in their own small circle of authority. The cluster of reasonable decisions killed one hundred and sixty seven people. What Cullen recommended and what the UK Health and Safety Executive built starting in 1992 is called the safety case regime. It requires an operator before they build or operate an installation to prepare a single document that identifies every major hazard on that installation, evaluates them all together, describes the control measures, and demonstrates that the total risk is acceptable. A regulator reviews the document independently and signs off on the total, not on each valve, not on each pump, on the whole. That regime has been operating in the UK offshore oil industry for over thirty years. It has been adapted for nuclear installations, for chemical plants, for rail. It's been imported into EU heavy industry regulation. It is at this point a mature, well understood, boring piece of regulatory infrastructure. Someone in the offshore oil industry, an industry not famous for restraint or transparency, figured out how to require that someone add up the whole. I'm telling you about a North Sea oil platform because this episode is about the same problem in a different industry right now in the United States. Whether you're in your car, out on a run, somewhere in the middle of your day, or in the shop bending wire, there are moments that don't announce themselves. They don't raise their voice, they don't stop the room, but they change everything.
Data Center Headlines From Three States
SPEAKER_01This is Edge of the Story, Season 2, Episode 9, I'm Daryl Best. Keep the platform in mind. We're coming back to it twice before the episode is over. Julia, take us to the headlines.
SPEAKER_00Our first headline this week is from Virginia. In its 20 and 26 legislative session, the Virginia General Assembly considered 61 bills directly related to data centers. Fifteen of those bills passed both chambers. Forty-six carried over to the 2027 session. Among the measures that passed, Senate Bill 253 restructures data center electricity costs, requiring facilities using 25 megawatts or more to pay for their own generating capacity. So those costs can't be shifted onto residential customers. A new tax of just over one cent per kilowatt hour takes effect July 1st of this year, capped at $600 million annually. Water minimization requirements now apply to cooling in groundwater scarce areas. And all new data center backup generators must meet Tier 4 emissions standards. Virginia's $1.6 billion annual data center sales tax exemption is still contested. Sources are Virginia Mercury and the state legislature's own records. In October of last year, the council rejected an annexation request from Atlas Development for a data center at Hawkins Academy Road and Roy Malcolm Road. In November, a series of two to one votes reversed that decision and approved essentially the same 151-acre, 1.5 million square foot project. The city's own planning commission had unanimously recommended against it. Two weeks after that, on November 18th, the council approved a second data center, 96 acres on East High Tower Trail. In January, the city passed a temporary moratorium and adopted new data center regulations, including noise and lighting limits and emergency drill coordination requirements. Then in late April, the same council unanimously approved a third project, more than 450 acres on Fairplay Drive and Roy Malcolm Road, over two million square feet of data center space. That is four separate votes in a town of 5,000 people, each of them defensible on its own terms. No vote ever taken on whether Social Circle wanted to be the data center hub for that stretch of Georgia. Sources are the Covington News and Data Center Dynamics reporting. Our third headline is from Oklahoma. This past legislative session, State Senator Kendall Sacchieri, a Republican from Blanchard, introduced Senate Bill 1488, which would have placed a three-year moratorium on new data centers larger than 100 megawatts and directed the Oklahoma Corporation Commission to study impacts on water supply, utility rates, and property values. The bill did not pass out of committee. It died during the session. Sakari has since filed for an interim study to be conducted this fall, so those findings can inform the next session. Meanwhile, Republican State Representative Brad Bowles of Marlowe has introduced House Bill 2992, the Data Center Consumer Ratepayer Protection Act of 2026, which takes a different approach, requiring data centers to pay infrastructure costs proportional to their electricity demand, rather than shifting those costs onto ordinary ratepayers. The Missing Framework For The Cluster
SPEAKER_01I want to go back to something Lord Cullen wrote in his report thirty six years ago because it's the whole argument of this episode in one line. He wrote that the previous regulatory regime before the disaster had been focused on, quote, prescriptive rules about individual pieces of equipment, close quote. Every valve had its own rule. Every pump had its own rule. What was missing, Cullen said, was any framework that required someone to look at the installation as a whole, to identify every major hazard together, to evaluate them together, to sign off on the total. That framework did not exist before Piper Alpha. Someone built it after. It has now been operating for thirty years. It is not controversial, it is not experimental, it is what an offshore oil operator in the UK has to do before they are allowed to operate, and it is what a nuclear operator has to do, and it is what a chemical operator has to do. The methodology exists in mature form in an industry whose product literally catches fire. Now, let's talk about what does not currently exist in the same mature form for the American Data Center buildout. How many data centers did Loudoun County, Virginia vote to approve? The answer, and I want you to sit with it for a moment because it is genuinely astonishing, is zero. Loudoun County in mid-2026 has roughly one hundred and ninety nine operating data centers and one hundred and seventeen more under construction. Data centers occupy about three percent of the county's land and they contribute around forty percent of its budget. It has been called Data Center Alley for decades, and no single vote of any elected body ever approved the cluster. What Loudoun County did was approve individual projects one at a time, each evaluated on its own, each reviewed in isolation from everything that came before it and everything that would come after. Every single one of those projects was defensible on its own terms. The cluster as a cluster was never evaluated by anyone. It was never approved, it just appeared. This is not corruption. I want to be careful about this because it is tempting and it is wrong to look at a hundred and ninety nine data centers in one county and conclude that somebody must have taken a bribe or fixed a vote. Nobody did. The system is not failing. The system is doing the only thing it was ever built to do, which is to consider one thing at a time. The analytical framework for adding up the whole exists in the United States. It has existed for four decades. It's called cumulative impact analysis under the National Environmental Policy Act first passed in nineteen sixty nine and under regulations issued starting in nineteen seventy eight, federal agencies were required to evaluate not just a proposed action on its own, but the combined effect of that action together with everything else past, present, and reasonably foreseeable. That framework has been used for forty years to evaluate hundreds of large infrastructure projects. Thousands of environmental consultants have been trained in it. Several states, including California, Washington, New York, and Massachusetts, have their own state level environmental review laws that still require it. The framework exists. In some jurisdictions it is required, in many others it is not. The uneven application is the story, and the build out is happening fastest right now in the jurisdictions that don't require
Loudoun County And The Transmission Lines
SPEAKER_01it. Let me take you to where that gap is landing right now. I want to stay in Loudoun County because the cluster nobody approved is now producing its next chapter in real time, and the story is a good deal sharper than the cluster itself. It's about the wires. A hundred and ninety nine data centers and one hundred and seventeen more under construction require enormous amounts of power. The way that power reaches them is high voltage transmission line, which has to be built across the county, connecting substations to the data center cluster in Ashburn. Dominion Energy, the utility, is building what it calls a three part reliability loop. Two of the three pieces are already approved and under construction. The third piece, the last one, is called the Golden de Mars Transmission Line, and it is where the cluster story became a personal story for a lot of Loudoun County families. The Golden de Mars Line, as approved, runs monopoles almost two hundred feet tall, almost two hundred feet, taller than the Statue of Liberty from base to torch. The route the Virginia State Corporation Commission approved on June 29th of this year is called Route 3A, and it runs directly through the Loudoun Valley Estates residential subdivision near two schools, Rock Ridge High School and Rosalie Carter Elementary. The route passes through the backyard of a woman named Vicki Who who has lived in her home for 20 years. She came to this country from Taiwan thirty years ago. She calls it her forever home. Now, here's where the story gets specific in a way that matters for the argument I've been making all episode. The State Corporation Commission has a process. It's a legitimate process. It reviewed Dominion's application, it heard from hundreds of community members, it considered several route options, and it ultimately concluded in the language of the Commission's own final order that Route 3A best serves the total public interest. The Commission also acknowledged, and Loudoun County's own staff concurred, that Route 3A would cause, and I'm quoting from the County's formal resolution here, substantial and unmitigated impacts to homeowners in Loudoun Valley estates, causing impacts to the use and enjoyment of their homes and to the value of their properties. So the county's own government has, on the record, agreed with the community that this route damages people. And the state's review process approved it anyway because the process asked, is this route acceptable? And the process answered in terms of the total public interest? Yes, the process did not ask. Was this cluster of data centers acceptable in the sum from the beginning? The process didn't have the authority to ask that. Nobody ever, along the way, was empowered to ask that. So by the time the question in front of the commission became where do we put the transmission lines to power this thing, the earlier question, should we have built this thing in this configuration at all, had been permanently closed by 199 individual defensible approvals, none of which was a decision about the cluster. The homeowners tried one last thing. On June twenty third, six days before the Commission's final order, the Loudoun Valley Estates Homeowners Association donated twelve point seven four acres of neighborhood open space to the Loudoun County School Board. Students use that land as a walking path to school. The donation was a legal maneuver, and everyone knew it. In Virginia, the State Corporation Commission cannot authorize condemnation of land owned by a school district. If the school board owned the land, the route could not, in theory, cross it. It was a Hail Mary. It did not work. The Commission ruled on june twenty ninth that the land could still be condemned and Route three A was the approved route. The Commission set a deadline. If the school board did not vote by july twentieth to authorize an alternative route across other squaw their school property, Route three A would become final and unchangeable. The County Board of Supervisors passed an emergency resolution. The school board held an emergency meeting at Rock Ridge High School on july thirteenth. Fifty residents spoke, and the board did something no one had quite predicted. It voted unanimously to file a formal statement of objections with the commission, catalog more than two dozen alleged legal errors in the approval, adopt a new policy banning all future transmission lines from school district property, and lay the groundwork for an appeal to the Virginia Supreme Court, which is the only court that can overturn a state corporation commission ruling. Vicki Who, standing in her backyard, said this to a reporter for WSA nine. Quote, this is how I feel they are cutting my arms off and they are expecting me to be okay. It is not okay. I want you to hold that sentence next to Loudoun County's 40% of budget from data centers and Loudoun's investment in a housing trust fund from the excess revenue and the tax rate that dropped from $1.14.5 to 80.5 cents per hundred dollars of assessed value over ten years. Those are all real. Those benefits are real, and so is Vicky Hughes' backyard, and the process that produced both and put them in the same county evaluated one project at a time without ever asking anyone to add up what all of them together would do to any single family living on the ground beneath them. That is not corruption. That is not incompetence. That is a system doing exactly what a system built to evaluate one project at a time will do over twenty years when nobody is required to weigh the
Who Pays The Price Of Growth
SPEAKER_01sum. At one of those Social Circles City Council meetings last November, the one where the two to one vote reversed the earlier rejection, a woman named Christina Studdard spoke. Stutterd doesn't live inside social circles city limits. She lives on the outskirts in the part of Walton County that gets the effects of what Social Circles Council decides, but has no vote in choosing that council. And she said this on the record to Atlanta News First, quote, We don't have a voting voice on this council that votes these projects in. They're saddling us with the effects of the developments. That is the sharpest single description I have found of the whole moment we are in, because studded or studded is not describing corruption. She is not accusing anyone of taking a bribe. She is describing in one sentence the structural gap the entire episode has been about. The people who bear the consequences of the cluster are not, in most cases, the same people whose votes assemble it. In Loudoun Valley estates, the people whose backyards are getting the transmission lines had no vote in the twenty years of individual approvals that made those transmission lines necessary. In Walton County, the people on the outskirts of social circle have no vote in the city council that keeps saying yes. Every vote is legitimate. Every vote is accountable to the people who cast it. And the cluster forms in the space between whose vote counted and whose backyard the wires ended up in. That is the engine under everything I just described. Loudoun Valley Estates is what happens when that engine has been running for twenty years. Social circle is what it looks like in year two. But here is where I want to bring us back because this is not a hopeless
Building Guardrails In Virginia And Beyond
SPEAKER_01story. This is a story about a framework that exists and a choice about whether to require it. Loudoun County itself, the county with 199 data centers and now transmission lines running through its neighborhoods, in March of 2025 took a step that almost nobody outside Virginia noticed. The Board of Supervisors voted to end all what they call buyright data center development. Before that vote, on many parcels in Loudoun, a data center could be built without any legislative approval from the board. After the vote, every new data center project has to come before the Planning Commission and the Board of Supervisors with mandatory community engagement. That is not by itself cumulative review. Louden's Still does not have a framework that requires someone to add up the whole. But Louden took the first meaningful procedural step that any American county has taken in this direction, and it was the county that had already produced the cluster nobody approved. The county that lived with the consequences was the county that changed the process. Vicki Hugh's fight is happening under the old rules. The next Vicki Hu in Loudoun County anyway will at least be able to see the fight coming. Virginia State Legislature this year is trying to do at the state level what Loudoun did at the county level. Sixty one bills, fifteen passed, cost allocation for grid infrastructure, emission standards for backup generators, water minimization requirements, a new consumption tax. Every one of those is a small piece of Cullen safety case translated in an American state legislative context. Add together and evaluate together and require someone to sign off on the total. The machinery exists. Loudoun has started to build it locally. Virginia has started to build it at the state level. Oklahoma has tried, and its state senators bringing it back through an interim study this fall. Indiana has passed a bill. New York's governor signed an executive order six days ago creating the first statewide moratorium on the largest data centers, while a broader bill from the legislature sits on her desk awaiting her signature. What is missing is not the methodology. What is missing is not the political will in any single jurisdiction. What is missing is the requirement to use it in the places where the build out is happening fastest before the build out finishes.
Piper Alpha As A Model For Maturity
SPEAKER_01Back to Piper Alpha for a moment. Lord Cullen did not conclude at the end of two years of testimony that the North Sea oil industry needed to slow down. He did not conclude that the industry was too dangerous to allow. He did not conclude that offshore oil was a mistake. What he concluded was that a mature industry that dealt in hazardous material had a duty before it operated to demonstrate to a regulator that it had considered the total risk of what it was doing together in one document with independent sign off. The framework Cullen recommended did not stop the North Sea oil industry. It is still there. It is still producing. The industry accepted every one of his recommendations, built the safety case regime around them, and has been operating inside that regime for over three decades. The industry did not die. It matured. That is the frame I want to hold up against the data center build out. This is not a question of whether to build. The build out is happening, it will keep happening. This is a question of whether the country building it is going to build the framework that requires someone to add up the hole before or after the cluster finishes appearing on top of the people who happen to live where it lands.
Social Circle And A Listener Callout
SPEAKER_01Julia just walked you through four votes in twelve months in a town of 5,000 people. I want to sit with what those four votes mean if you are a listener in social circle right now, because we know some of you are. Our download map has been telling us so for months. Meta built its flagship Georgia Data Center just outside town years ago at a development called Stanton Springs, 970,000 square feet, around ten million dollars a year in property tax revenue for Walton County, about three hundred people employed, by the standards of the industry, a good outcome. Social Circle was, for a while, the town in Georgia that people pointed to when they wanted to argue that data centers could work. Then the build out came for the rest of Social Circle. Here is what I want you to notice about the four votes Julia just described. Social Circle is not a passive place. The Planning Commission voted against a project. The city council rejected one, then reversed itself, then approved another one two weeks later, then paused everything to write real regulations, then approved a four hundred and fifty acre complex under those new regulations three months later. Every single one of those votes was legitimate. Every single one was cast by people accountable to their neighbors in public meetings on the record. The regulations they wrote are serious regulations, noise limits, lighting limits, emergency drill coordination. None of that stopped the cluster from forming. Because nobody in Social Circle voted ever on the question do we want to be the data center town for this stretch of Georgia? That question is being answered right now by four separate votes on four separate projects. And the answer in aggregate is yes, because there is no mechanism in a city of 5,000 people or a county of a hundred thousand that would let anyone ask the aggregate question in the first place. To our listeners in social circle, this show sees you. What is happening in your town is not unusual. It is the pattern. And it is right now the sharpest current example we have found of the argument this whole episode has been making. You are the moment noticed.

The Known Answer And The Policy Choice
SPEAKER_01All 106 recommendations were accepted. The industry had spent decades treating safety as a compliance box to check. It walked in the space of about four years into treating safety as a document it had to write and defend before it was allowed to operate. It's been almost 40 years now. There has not been another Piper Alpha in the UK offshore sector. The industry did not die. It matured. Somebody in one of the least sympathetic industries in the world figured out how to build the framework that required adding up the whole. The framework we need for what we're building now already exists, in Cullen's report. In four decades of American environmental practice in the safety case regime still operating, in every state legislature currently trying to write it back into law. In Loudoun County, Virginia, which is reacting to 20 years of buildup, it never voted on as a whole. In Social Circle, Georgia, where a town of 5,000 is trying to put the pieces together while the build out is happening around them. And in Oklahoma where a state senator saw the pattern and tried to get ahead of the curve before her state became a Louden or a Social Circle. What we do not have yet is the requirement. That is a policy choice. It sits in front of legislatures and county commissioners and Congress. And unlike almost everything else we have covered on this show, it is a choice about which the answer is genuinely known. Somebody has done the work.
When Politics Turns Violent
SPEAKER_00Instead, you opened with a door someone shot at.
SPEAKER_01Somebody put thirteen bullets through a councilman's front door because he voted for a data center rezoning. His son was playing with Legos at the dining room table the day before. I could not write a chapter about the real choices in front of the country without acknowledging that. But I also did not want that door to become the frame that eats the chapter because the people who shot at Ron Gibson's house are not the opposition. The opposition is the people who show up at commissioners' meetings and file testimony and start nonprofits. The door is what it looks like when someone gives up on those channels entirely. It's a warning about what happens if the legitimate channels start to feel unreal to the people using them.
SPEAKER_00Chapter 13 is called the Homework Assignment. What did doing the homework yourself change about how you thought about the race with China argument?
SPEAKER_01It made me less sure of it, and I think it should make other people less sure of it, and that's the whole reason the chapter exists. The argument that we have to build everything as fast as possible, guardrails be damned because China is coming is the argument that ends every county meeting when it gets invoked. And it may be right. But then in January of twenty twenty five, a Chinese startup called Deep Seek released a model that performed near the frontier, trained for about five point six million dollars on chips that have been deliberately throttled by American export controls. Same month Stargate got announced at the White House for $500 billion. The export controls were supposed to keep China years behind. They may have accidentally taught China how to be radically more efficient than us. I cannot tell you which of those readings is right. The people whose full-time job is to know disagree in public. What I can tell you is that the argument being used to end every county meeting is more contestable than the people using it led on. And a contestable argument shouldn't be used to end conversations.
China Speed Argument Gets Tested
SPEAKER_00Chapter 14 is the argumentative core of the whole book. You call it structure, working exactly as designed. Say more about the difference between blaming corruption and blaming structure. Because for a reader who has been trained to look for villains, structure is a harder thing to fight.
SPEAKER_01It's harder to fight and it's the only thing worth fighting. If 199 data centers ended up in Loudoun County because somebody took a bribe, we would know how to fix that. There are laws, there are prosecutors. That is a solvable problem. But nobody took a bribe. What happened is that a process built to evaluate one project at a time did exactly that faithfully over and over for twenty years until the cluster appeared. The system is not broken. The system is doing what it was built to do. If you want a different result, you have to build a different system, which is much harder than finding a villain and much slower and much less satisfying. But it is the only fix that would actually work.
Owning The Hidden Costs Of AI
SPEAKER_00The book ends at a Denny's booth in San Jose where NVIDIA was founded, and then the afterword does something I have not seen a book do before. You disclose that you used artificial intelligence to write the book, and that means you personally may have taken twelve gallons of Beverly Morris's water. Why put that in the book and why put it last?
SPEAKER_01Because if I don't say it, the book fails at its own thesis. The thesis of the whole book is that the cost of this infrastructure lands on the people who happen to live closest to it, and that most of us who use the infrastructure never think about that. I use the infrastructure to write the book. I used it a lot. Estimates for a project this size range from about half a gallon of water to about twelve gallons of water depending on which methodology you trust. Beverly Morris's well went dry in Newton County, Georgia, next to a Meta data center. I may have taken twelve gallons of her water writing about her. If I don't say that, then I've written a book that lets the reader off the hook the same way the industry lets itself off the hook. Somebody else did this, somebody else should fix it. That's not honest. So are you.
